Treaties are only enforceable if 2/3s of congress ratifies them. Until that happens, a treaty is nothing more than a suggestion. Ratified treaties are relatively rare (as they should be), because no one in our government ever wants to give up power.
The International health regulations were amended in 2005 and are being done so again. Second there is de facto and de jure. We have national governments that will de facto do what they have been doing.
